Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tono mobile application, website, and related services (collectively, the "Service") provided by Tono ("Tono," "we," "us," or "our").

By downloading, accessing, purchasing, or using Tono, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Tono is an educational music-training application designed to help users practice pitch recognition, ear training, note comparison, singing and pitch exercises, and related musical skills.

Tono may include features such as:

• personalized training and practice recommendations;
• Pitch Map, mastery tracking, and adaptive note selection;
• streaks, XP, and progression;
• microphone-based pitch detection; and
• audio playback.

Features may change or evolve over time.

2. Eligibility

You must be at least 13 years old, or the minimum age required to use the Service in your jurisdiction. If you are below the age of majority where you live, you should use Tono only with the permission of a parent or legal guardian.

3. Accounts

At launch, Tono supports Sign in with Apple. An account may be used to identify you, save your progress, synchronize Pitch Map data, restore personalized training information, and associate purchases or entitlements with you. You are responsible for maintaining access to your account and device.

You can initiate account deletion through Tono → Profile → Settings → Delete Account. Deletion is permanent with respect to Tono cloud progress, subject to information we must retain by law.

Deleting a Tono account does not automatically cancel an App Store subscription.

4. Educational Results

Tono is an educational tool, and training outcomes vary between users. We do not guarantee perfect pitch, any specific improvement, improvement within a particular number of days, or achievement of a particular musical skill level.

Pitch Map values, mastery scores, personalized recommendations, weak-note detection, and progress estimates are generated from your activity in Tono. They are not professional assessments of hearing health or musical ability. Tono is not a substitute for medical advice, hearing care, diagnosis, or professional music instruction.

5. Subscriptions and Purchases

Tono may offer a weekly auto-renewing subscription, a yearly auto-renewing subscription, and a Lifetime one-time purchase. Weekly and yearly subscriptions may include a 7-day free trial where available and where you are eligible. Lifetime does not include an App Store free trial.

Actual prices, currencies, trial availability, billing periods, and introductory offers are displayed through the App Store at purchase time.

Weekly subscription

The weekly subscription renews each week until cancelled.

Yearly subscription

The yearly subscription renews each year until cancelled.

Lifetime

"Lifetime" refers to access to the applicable purchased Tono features for as long as Tono continues to operate and is reasonably able to provide those features. It does not refer to the purchaser's lifetime and does not guarantee that every current or future feature will remain available indefinitely.

Lifetime access is personal, non-transferable, and associated with the purchasing App Store account and/or the corresponding Tono entitlement.

6. Free Trials, Billing, Renewal and Cancellation

Eligible subscriptions may include a 7-day free trial. Apple and App Store rules determine eligibility. Unless you cancel before the trial ends, the subscription converts to a paid subscription. Subscriptions automatically renew unless cancelled, subject to the terms shown by Apple at checkout.

Apple handles billing. You can manage or cancel a subscription through your Apple ID or App Store subscription settings. Deleting Tono from your device does not cancel a subscription, and deleting your Tono account does not cancel a subscription. Taxes may apply where required.

7. Refunds

Purchases are processed by Apple. Refund requests are generally handled according to Apple's policies; Tono does not promise refunds directly. Nothing in these Terms limits any rights you have under applicable consumer-protection law.

8. License and Intellectual Property

Tono grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

Tono's software, mascot, branding, artwork, sounds, exercises, interface, text, and visual designs remain owned by or licensed to Tono. No rights are granted except as expressly stated in these Terms.

9. Acceptable Use

You may not:

• use Tono unlawfully;
• attempt unauthorized access to the Service or related systems;
• bypass subscription or entitlement checks;
• reverse engineer the Service except where the law expressly permits it;
• scrape the Service or overload its systems;
• abuse, disrupt, or interfere with the Service;
• redistribute or commercially exploit Tono without permission; or
• impersonate another user.

10. Privacy and Microphone Use

Our Privacy Policy explains how Tono handles personal information. Certain features may require microphone access. Raw microphone audio used for pitch detection is processed locally on your device. It is not uploaded to Tono, transmitted to Tono's servers, or stored by Tono.

Tono may store resulting training information, such as the detected note or pitch result, whether the attempt was correct, mastery changes, and lesson progress.

11. Third-Party Services

Tono currently relies on third-party services, including:

• Apple, for Sign in with Apple, App Store distribution, purchases, and subscriptions;
• Supabase, for authentication infrastructure, cloud database services, and synchronized account and progress data; and
• RevenueCat, for purchase validation, subscription status, and entitlement management.

These services may have their own terms and privacy policies. Tono does not control third-party services and is not responsible for changes those providers make to their services.

12. Service Availability and Changes

Tono may update, modify, add, or remove features and may temporarily suspend parts of the Service. We do not guarantee that the Service will always be available, uninterrupted, or error-free.

13. Disclaimers

To the extent permitted by applicable law, the Service is provided "as is" and "as available." Tono disclaims warranties and conditions not expressly stated in these Terms, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted availability, perfect pitch detection, error-free operation, permanent storage of progress, or specific learning outcomes. Some jurisdictions do not permit certain exclusions, so some of these exclusions may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Tono will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the Service or these Terms.

To the maximum extent permitted by applicable law, Tono's total liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of (a) the amount paid to Tono during the 12 months preceding the event giving rise to the claim or (b) CAD $100. These limitations do not apply where liability cannot legally be limited or excluded.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Tono harmless from claims, losses, liabilities, and reasonable costs resulting from your unlawful use of the Service, violation of these Terms, violation of third-party rights, or misuse of the Service.

16. Suspension and Termination

Tono may suspend or terminate access where reasonably necessary because of a violation of these Terms, fraud, unlawful activity, abuse, or a security risk. You may stop using Tono at any time.

Deleting an account does not cancel an App Store subscription.

Provisions that by their nature should survive termination will survive, including provisions concerning ownership, disclaimers, limitations of liability, indemnification, governing law, and accrued obligations.

17. Changes to These Terms

Tono may update these Terms as the Service changes. We will update the last-updated date and provide additional notice when legally required. Your continued use of the Service after updated Terms take effect means you accept the updated Terms, where permitted by law.

18. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.
